4. Data protection

Data protection

The protection of your personal data is particularly important to us. We therefore process your data exclusively on the basis of the legal provisions (GDPR, TKG 2003). In this data protection information we inform you about the most important aspects of data processing on our website.

Personal Data

The personal data you provide electronically on this website, such as name, email address, or other personal information that you voluntarily provide to us, will only be used and stored for the purpose specified in each case. When you use an online form, your IP address is also stored in order to be able to trace any illegal or unwanted use (such as hacker attacks or spam).

The provider automatically collects and stores information on the web server such as the browser used, operating system, referral page, IP address, time of access, etc. This data cannot be assigned to specific people without checking other data sources and we do not evaluate this data further as long as it is not unlawful use of our website.

Right to information and cancellation

In principle, you have the rights to information, correction, deletion, restriction, data portability, revocation and objection. In this case, please send an email to office@fk-bier.at. If you believe that the processing of your data violates data protection law or your data protection rights have been violated in any other way, you can complain to the supervisory authority. In Austria this is the data protection authority.

Cookies

Our website uses so-called cookies. These are small text files that are stored on your device using the browser. They do no harm. We use cookies to make our offering user-friendly. Some cookies remain stored on your device until you delete them. They enable us to recognize your browser the next time you visit. If you do not wish this, you can set up your browser so that it informs you about the setting of cookies and you only allow this in individual cases. If cookies are deactivated, the functionality of our website may be restricted.

hCaptcha

We use the anti-spam/bot service hCaptcha (hereinafter “hCaptcha”) on our website. This service is provided by Intuition Machines, Inc., a Delaware US Corporation (“IMI”), 350 Alabama St, San Francisco, CA 94110. hCaptcha is used to check whether the data entered on our website (e.g. on a login page or a contact form) was entered by a human or by an automated program. To do this, hCaptcha analyzes the behavior of the website or mobile app visitor based on various characteristics. This analysis starts automatically as soon as the visitor to the website or mobile app enters a part of the website or app with hCaptcha activated. For the analysis, hCaptcha evaluates various information (e.g. IP address, how long the visitor has been on the website or app, or the user’s mouse movements). The data collected during the analysis is forwarded to IMI. IMI acts as a “data processor”. hCaptcha analysis in “invisible mode” can take place completely in the background. Website or app visitors are not informed that such analysis is taking place if the user is not shown a prompt. Data processing is carried out on the basis of Article 6 Paragraph 1 Letter f of the GDPR: The website or mobile app operator has a legitimate interest in protecting its site from abusive automated crawling and spam.

So-called standard contractual clauses (SCC = Standard Contractual Clauses) are used as the basis for data processing or transfer for recipients based in third countries such as the USA. These are templates provided by the EU Commission to ensure that data protection complies with European standards even if your data is transferred to third countries and stored there. Through these standard contractual clauses, providers such as hCaptcha undertake to comply with European data protection standards when processing personal data. The resolution on the standard contractual clauses can be found here: https://eur-lex.europa.eu/legal-content/DE/TXT/?uri=CELEX:32021D0914

IMI’s data processing agreement, which refers to the standard contractual clauses, can be found at: https://newassets.hcaptcha.com/dpa/IMI.DPA.9.23.21.New.SCCs.pdf
